Breaking: Supreme Court Will Grant Hearing to Prop 8 and DOMA

The Supreme Court finally stopped cock-teasing us and announced that it will grant hearing of both the Prop 8 and DOMA cases. While Prop 8 really didn't need a hearing (and hate groups are jumping gleefully, pointing this out and claiming it's a sign that SCOTUS will overturn the 9th Circuit's decision), I am definitely excited about DOMA, since they have picked the Windsor case - the one with high scrutiny that has a higher chance of being upheld by the Supreme Court. Personally, I am optimistic, and after ten consecutive courts declared that abomination as unconstitutional, I'm having a hard time imagining SCOTUS deciding otherwise, even with all the conservative doom and gloom that presides over it.

9th Circuit Denies En Banc Hearing

Yes! The 9th Circuit refused to allow an en banc hearing of the Prop 8 case. Here's the ruling itself, and now begins the 3 months stay during which time the hate groups can try and get the Supreme Court to kick their asses too. After the grace period has passed, Prop 8 will be struck down.

9th Circuit to Decide on Course of Action on Prop 8 Trial Tomorrow

According to Prop 8 Trial Tracker:

If that happens, Judge Reinhardt’s narrow opinion stands, and the proponents of Proposition 8 can then petition for certiorari at the Supreme Court. If the Supreme Court were to deny review, the Ninth Circuit’s decision would stand, and Proposition 8 would be struck down. Gay and lesbian couples would be allowed to marry in California. If the Supreme Court grants review, there will be briefing and oral argument and a decision next year.

The Proponents of Prop 8 Ask for a Full 9th Circuit Review

Filed under "severe annoyance". The proponents of the (now twice voted as) unconstitutional Proposition 8 will ask for an En Banc review. That means the fight to strike that disgrace down from the law is going to take longer, as the 9th Circuit has to first decide whether to take the case again, and then if it does, it's unclear as to how long it will take them to reach a conclusion. Then the haters could keep annoying us by going for a Supreme court review. After waiting for all deadlines to be nearly over of course. It is seriously pathetic to keep fighting an obviously losing fight, but they are determined to make it as prolonged as possible, out of - seems like - pure spite.
